Terms of Service

1. Acceptance of Terms
By accessing or using Fixmark (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Fixmark is a maintenance tracking tool for small landlords. The Service allows you to manage properties, track maintenance requests, assign vendors, and export records. Fixmark does not provide rent collection, lease management, or accounting services.
3. Accounts
You must provide a valid email address to create an account. Authentication is handled via email magic links. You are responsible for maintaining the security of your account and for all activity that occurs under it.
4. Billing & Payments
Fixmark is billed at $3 per unit per month with a $15 monthly minimum. Your bill adjusts automatically when you add or remove units. You are charged for the units you have at the end of each billing period. Free setup is available before going live.
5. User Content
You retain ownership of all data you submit to the Service, including property information, maintenance requests, photos, and vendor details. You grant Fixmark a limited license to store and process this content solely to provide the Service to you.
6. Tenant Request Links
Each unit may have a unique shareable link that allows tenants to submit maintenance requests without creating an account. You are responsible for sharing these links only with intended recipients. Submissions through these links are associated with your account.
7. Acceptable Use
You agree not to misuse the Service, including but not limited to: attempting to gain unauthorized access, interfering with other users, uploading malicious content, or using the Service for any unlawful purpose.
8. Termination
You may close your account at any time. Fixmark reserves the right to suspend or terminate accounts that violate these terms. Upon termination, your data may be deleted after a reasonable retention period.
9. Limitation of Liability
Fixmark is provided “as is” without warranties of any kind. To the maximum extent permitted by law, Fixmark shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.
10. Changes to Terms
We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms. We will notify users of material changes via email.
